1) Who we are

This online store (the “Store”) is hosted on Shopify (the “Platform”).
2) Scope & agreement
These Terms govern your access to and use of the Store and purchases you make. By using the Store you accept these Terms as well as our Privacy Policy, Cookie Policy, Shipping Policy, and Refund Policy.
3) Eligibility & accounts
You must be of legal age in your country to purchase. Creating a customer account is optional; you are responsible for safeguarding your login credentials and for activity under your account.
4) Products & digital content
We sell digital embroidery patterns (PDF) and physical items (3D-printed display frames, finished embroideries). We aim to describe items accurately; minor color/appearance variations may occur due to screens and materials. We may change or discontinue products at any time.
Personal-use license (digital patterns)
When you buy a PDF pattern, we grant you a non-transferable, personal license to download and use it for personal, non-commercial purposes (including making gifts).
Redistribution, resale, or sharing of the files or instructions is not permitted. For selling finished items made from a pattern, contact us about a small-batch/commercial license.
5) Prices, taxes & payment
Prices are shown in EUR. As a Kleinunternehmer gemäß § 19 UStG, we do not charge or show VAT. Shipping costs (if any) are shown at checkout. We accept the payment methods listed at checkout (currently Shopify Payments and PayPal). A contract is formed when payment is authorized and we send you an order confirmation.
6) Order process, contract language & storage
Steps to purchase: add to cart → enter details → choose shipping/payment → review → submit order. The contract languages available are shown in the Store (currently English; German may be available for localized pages). We store the contract text (order details) in our systems; the order summary is emailed to you and, if you created an account, is accessible in your account.
7) Delivery & downloads
Digital patterns: immediate access on the order confirmation page and via email. By opting for immediate delivery at checkout, you acknowledge that your right of withdrawal ends when the download begins (details in Refunds & Returns).
Physical items: ships from Germany. Processing time 1–3 business days (no weekend/public-holiday dispatch). Estimated delivery times are in the Shipping Policy.
Risk & title: For consumer purchases, risk passes to you upon delivery of the goods.
8) Returns, withdrawals & refunds
Your rights are explained in Refund Policy, which includes the EU Widerrufsbelehrung (right of withdrawal) and model form.
Digital items: non-refundable once the download begins (after your express consent to immediate delivery).
Physical items: 14-day return window for unused items; you pay return shipping unless the item is faulty/incorrect. Refunds are issued to the original payment method; original shipping is refunded up to the least-expensive standard option.
9) Shipping limits, customs & addresses
We ship to the countries listed in the Shipping Policy. Non-EU deliveries may be subject to customs duties/taxes, payable by you. Provide a complete, deliverable street address (no PO Boxes/Packstation where our carrier cannot deliver).
10) User content & reviews
If you post reviews or send ideas/feedback, you grant us a worldwide, royalty-free license to use, reproduce, and display that content for Store operations and marketing. Post only content you have rights to and that is lawful and respectful; we may moderate or remove content at our discretion.
11) Intellectual property
All designs, text, graphics, photos, and other materials in the Store are owned by us or our licensors. Except for the personal-use license for purchased patterns, no rights are granted. Do not copy, share, or redistribute our files or product images without permission.
12) Prohibited uses
You may not use the Store for illegal acts; IP infringement; attempting to breach security; scraping; spreading malware; posting unlawful, defamatory, or obscene content; or interfering with others’ use of the Store.
13) Warranties & legal guarantees
Nothing in these Terms limits your statutory consumer rights. For physical goods, the statutory legal guarantee applies. For digital content, we will supply content that conforms to the contract and applicable law.
14) Liability
We are liable without limitation for intent and gross negligence, for injury to life, body, or health, and under the German Product Liability Act. For slightly negligent breaches of material contractual duties (duties whose fulfilment enables proper performance and on which you regularly rely), liability is limited to foreseeable, typical damages. Otherwise, liability is excluded. Your statutory rights remain unaffected.
15) Third-party services & links
The Store runs on Shopify. Payments are processed by Shopify Payments and/or PayPal. Third-party links or tools may be offered “as is”; the respective providers’ terms and privacy policies apply.
16) Privacy & cookies
We process personal data as described in our Privacy Policy and Cookie Policy. Because the Store is hosted by Shopify, certain data is processed by Shopify and payment providers to operate the Store and complete orders.
17) Online dispute resolution (ODR) & consumer ADR
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
18) Changes to these Terms
We may update these Terms. The current version is posted here with the “Last updated” date. Material changes will be communicated as required by law.
19) Governing law & venue
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in the EU/EEA/UK, mandatory consumer protection rules of your country of residence also apply.
Place of jurisdiction is Berlin, Germany, if you are a merchant or have no general place of jurisdiction in Germany; otherwise the statutory venues for consumers apply.
